Abstract

In the article an attempt to build a logical system of criminalization bases was made. It is proposed to highlight the objective
(associated with the act), socio-historical and state-legal criminalization bases. The first block of bases includes the social danger of an
act requiring criminalization, relative prevalence and typicality as well as the negative dynamics of socially dangerous acts. The sociohistorical
bases suggest setting a certain level of social consciousness and consideration of the historical traditions of the country. The
state-legal bases for criminalization consist in the impossibility of influence on socially dangerous behavior by other non-criminal law measures; the absence of the fixed legal consequences of such acts in the current norms of criminal law; predictive positive results that can lead to prospective criminalization; and consideration of the real capabilities of the bodies of the criminal justice system. Particular
attention is paid to the importance of the criminal law science terminology and its influence on the criminalization bases.
