Abstract

In the paper an analysis of constitutional and legal status of advocacy in Ukraine is done. The conclusion is that advocacy is one
of the basic elements of the mechanism to ensure the rights, freedoms and lawful interests of person; its level of development in a society directly indicates the level of democracy development. The article points out that the Constitution of Ukraine gives the advocacy an important role, and makes it a key human rights institution in the modern legal system of Ukraine. The attention is drawn to the recent positive changes in the Constitution of Ukraine (regarding justice), by means of which the monopoly on the implementation of basic
types of legal assistance (protection and representation) is reserved exclusively for lawyers.
