Abstract

Family is a key concept of family law. However, today neither in the specialized literature, nor in the legislation there
is unity in the solution of the question of what a family is. The article analyzes such signs of a family as: the presence of
moral support between family members; cohabitation of family members; community of the economy; mutual material support,
etc. Based on the analysis, it is concluded that all those signs that are most often identified in the science of family law
as signs characterizing the family as a legal institution are additional, their presence is desirable, but not necessary. The signs
of the family as a legal institution include the presence of a legal connection between family members and an indication of
legal facts that entail the emergence of marriage and family rights and obligations between them.
