Abstract

The article considers the issues of qualification of crimes committed by a group of persons by prior collusion. The author
analyzes the subject composition of this group from the point of view of the legislator, criminal law science and law enforcement
practice. Attention is drawn to the fact that the Plenum of the Supreme Court of the Russian Federation interprets the sign “group
of persons by prior collusion” narrowly. It is proposed to change the legislative definition of this form of complicity in order to
reflect in it the composition of this group only in the form of co-executors.
