Abstract

The article examines the constitutional and legal basis of the competence of the State Inspectorate for the Protection of Fauna and Flora under the President of the Republic of Belarus, and proposes a holistic definition of this concept. The author analyzes the essential content of the category “competence”, reveals its multi-vector nature, reflects the relationship with the concepts that are closest in meaning, and identifies the sources of formation and conditions for limiting competence. The researcher emphasizes that, being an integral element of the legal status of a government body, competence is a kind of guarantee of ensuring the fulfillment of its goals, objectives and functions. The scope of competence of a state body, first of all, is formed on the basis of its powers, the list of which is established by law in accordance with the tasks and functions assigned to this body within the scope of its activities. An important feature of the competence of a state body is its derivativeness from the competence of the state, which fully complies with the constitutional principle of the rule of law, reflects the role of each state body in the activities of the entire state system, and increases its stability and efficiency.
